<p>Child labor <a href="https://www.timeclockwizard.com/flsa-regulations-and-computing-overtime-pay">laws and reforms</a> were passed in several waves. The last and most comprehensive of which was the <a href="https://www.timeclockwizard.com/business-owners-guide-to-federal-employment-and-labor-laws">Fair Labor Standards Act</a> (FLSA) of 1938. Before that, however, was a &#8220;perfect storm&#8221; of factors and influences that pushed and pulled on the institution of child labor.</p>
<h2>Prior To FLSA</h2>
<p>Before 1938, children had been working in all kinds of jobs and all kinds of conditions. In the rural United States children were expected to help out on family farms and shops as soon as they were able. Additionally, they were hired out to other family farms in the area.</p>
<p>As more mechanized forms of production became more commonplace in the big cities, people began moving from the country into the cities for better employment opportunities. Furthermore, people began moving to the United States from other countries for work, leading to the opening of even more factories.</p>
<p>At this time, companies had a lot of incentive to hire small children. They could be paid less, they were easier to manage, and they were physically smaller and therefore fit into work space grown adults could not.</p>
<h2>Child Labor Advocacy</h2>
<p>In the early part of the 20th century, child labor peaked. Shortly thereafter, labor movements began for adult workers, who grew in political power and began demanding better labor standards. The labor movement led to a decline in child labor which was often abusive to children.</p>
<p>The National Consumers League, founded in 1899, and the National Child Labor Committee, founded in 1904, shared a common goal. And that was of reducing exploitative child labor. The National Child Labor Committee soon began pushing for child labor reforms at the state level. And those laws were often joined with compulsory education laws. Laws which began picking up momentum in the middle of the 19th century.</p>
<p>In 1916, and under pressure from these two organizations during the height of the progressive movement, the United States Congress passed the Keating-Owen Act. It was the first federal child labor law. It regulated interstate commerce that involved products produced by children under certain ages. But the Supreme Court rendered it unconstitutional saying it violated the commerce clause of the Constitution. In 1918, Congress tried to levy a tax on business with child workers, but Congress again stuck this down.</p>
<p>Finally in 1924, Congress passed an amendment allowing the federal government power &#8220;authorizing federal child labor legislation&#8230;&#8221;  But it did not have enough state support to be ratified.</p>
<h2>The Effects of The Great Depression on Labor</h2>
<p>The Great Depression changed political attitudes in the US, particularly with regards to child labor. There were not enough jobs for working adults, and President Roosevelt&#8217;s New Deal acts sought to limit child labor. In 1936, the Public Contracts Act limited the ages that boys and girls could work on goods that supplied to federal contracts. In 1938, the Fair Labor Standards Act set the minimum working age for children both during and outside school hours.</p>
<p>Not only did these laws go a long way in curbing abusive child labor practices, but able-bodied adults were able to get jobs that had previously gone to children.</p>

A company which has a comp policy allows its employees paid time off work at the same rate that they would have paid them if they were to pay for overtime. In the U.S., employees are expected to work 40 hours each week. Any additional time worked must be paid either as overtime pay or compensatory time.</p>
<h2><strong>Compensatory Time Vs. Overtime Pay</strong></h2>
<p>For organizations that have flexible work schedule programs, compensatory time may be offered to employees in lieu of overtime pay. This would apply when workers exceed the 40 hours per week limit. The paid time off can be given to salaried employees who are asked to work extra hours under flexible schedules.</p>
<p>Employers must make sure that they compensate their employees for paid time off. And it should be at the same rate that they would have paid those employees for overtime. An employer may be held in violation of the Fair Labor Standards Act (FLSA) if it fails to use identical rates for compensatory time and overtime pay.</p>
<h2><strong>Who Qualifies for Compensatory Time?</strong></h2>
<p>The answer to this question depends on whether the employee is exempt or nonexempt. Since exempt employees do not qualify for overtime pay under the FLSA they are often given compensatory time to reward them for the extra time that they put in. On the other hand, nonexempt employees are commonly covered by the employment regulations of the FLSA, which demand that they must be paid overtime pay for extra hours worked. Therefore, this group of employees are ineligible for compensatory pay. These employees cannot qualify for comp time because of the requirements of the FLSA.  This law expressly demands that they must be paid for every additional hour that they have worked in excess of the normal 40 hours per week.</p>
<p>Employers must acquaint themselves with the rules and regulations that govern compensatory time and overtime pay in their states. Failure to compensate nonexempt employees in accordance with the law can land an organization in serious legal problems.</p>
<h2><strong>Is Compensatory Time Offered to Employees in Both the Public and Private sectors?</strong></h2>
<p>Formally recorded and structured compensatory time occurs frequently in the public sector where employees are represented by unions. Most private sector employers do not offer compensatory time to their salaried exempt employees. This is due to the fact that they don’t want these employees to take on an hourly work mentality. These employers prefer their employees to embrace mindsets that promote job accomplishment and goal achievement. And  doing what it takes to complete a job in good time and with acceptable quality.</p>
<p>This leads us back to the question:</p>
<h2><strong>Do Salaried Employees Get Compensatory Time?</strong></h2>
<p>The answer is yes and no. It is &#8220;yes&#8221; if the employees are classified under those who are nonexempt and work for the public sector. Therefore, you must you must be nonexempt and also work for the public sector to received <a href="https://www.timeclockwizard.com/payroll-and-attendance-systems-continued">comp time</a> for the accrued time worked past the 40 hours per week threshold.</p>

<p>Prior to enacting the Fair Labor Standards Act in 1938, the United States didn’t have a minimum wage. Employers could pay their workers whatever rate they chose. Since enacting the law, however, the federal and state governments have dictated a minimum wage to employers. While the least acceptable wage is established by the federal government, individual states may require businesses operating within that jurisdiction to adhere to a higher wage requirement. <p>Nationally, the minimum wage is $7.25 per hour, and the majority of states do adhere to that hourly rate. States with a significantly higher cost of living do try to compensate by also establishing a higher minimum wage. California, for instance, has enacted a $10.50 hourly minimum wage. While some cities in the state have established a minimum pay rate that’s even higher than the state minimum. As of January 1, 2018, the state of California will add a .50 cent increase to their minimum wage.</p>
<p>Each consecutive year will see another increase of $1.00 to bring the minimum wage to $15 per hour by 2022.</p>
<p>San Francisco will see a minimum wage of $15 by the start of 2018 and Los Angeles will see the same wage requirement for employees of large companies by the year 2020.</p>
<p>Outside of California, Montgomery County in Maryland has raised their minimum wage from $10.75 to $11.50, an increase that was established in July of this year. Chicago pays an $11 minimum wage with plans to bolster that rate up to $13 by 2019. Elsewhere in Cook County, plans to increase the minimum wage to $13 will take effect by 2020.</p>
<h3><strong>When Can a Company Elude the National and State Minimum Wage Requirements?</strong></h3>
<p>While state and local governments may allow for certain changes to the federally mandated minimum wage laws, not all businesses must comply with the minimum wage laws at any level. For example, an employee who receives tips is only required to be paid a $2.13 minimum wage under federal law. The stipulation is that the amount received in tips, plus the $2.13 hourly wage, must equate to the standard $7.25 hourly requirement. In cases where the total does not equate the federal minimum wage of $7.25, the employer is required to make up the difference.</p>
<p>For workers under the age of 20, employers must pay $4.25 per hour. This is regardless of how much the employee receives in tips. This requirement applies to the first consecutive 90 days of employment. <a href="https://www.timeclockwizard.com/employee-relations/new-hire-probationary-period" class="wcf-anchor-link">Following this probationary period, the worker</a> must be paid $5.85 per hour.</p>
<p>Many are exempt from the minimum wage law. Some examples being babysitters working a casual schedule, companions for elderly persons, and fishing workers. In cases where the minimum wage law does apply, it’s up to the worker to ensure that the employer is paying the appropriate wage. If there is a discrepancy, a complaint can be filed with the Compliance Section of the U.S. Department of Labor Employment Standards Administration Wage and Hour Division.</p>

<p>The two most confused phrases among first time employees are gross pay versus net pay. The simple way to remember the difference between these two is that gross pay is what you earned before taxes have been deducted. While net pay is what remains after taxes are deducted. <h2>Tracking Net Pay</h2>
<p>Net pay is important to track from one pay period to another. If wages are directly deposited to your bank account, you will receive a <a href="https://www.timeclockwizard.com/outsourcing-payroll-why-companies-do-it">payroll</a> voucher. This will list all of the taxes deducted from your gross pay.</p>
<p>The voucher usually includes a copy of a payroll check with the words, &#8220;Non Negotiable&#8221; stamped on the authorized signature line where your employer normally signs your check.</p>
<p>The reason it is important to track your net pay is so you can verify all deductions are accurate. Please note those that change during the course of your employment year. The amount of your paycheck after taxes depends on the gross amount paid to you by your employer.</p>
<h2>Know Your Payroll Tax Deductions</h2>
<p>In order to know what your take home pay will be, you need to know which payroll taxes have been deducted. and what the amounts of these deductions are. These include:</p>
<ul>
<li>Social Security</li>
<li>Medicare</li>
<li>Federal Withholding</li>
<li>State taxes like state unemployment, state income taxes &amp; state Medicaid</li>
</ul>
<p>All deductions are found on your payroll voucher as year-to-date (YTD) and current pay period deductions. This is along with current deductions and total amount YTD.</p>
<h2>Rate of Taxation</h2>
<p>The Internal Revenue Service (IRS) designates each employee&#8217;s wages in <a href="https://www.timeclockwizard.com/minimum-wage">income tax brackets</a>. To know what your paycheck after taxes will be, you need to know what your particular income tax bracket is for the year in which you are paid.</p>

<p>When you were hired, you filed a W4 form provided by your employer so he could withhold current, correct payroll tax deductions from your wages. When you filed the W4, you listed your tax status as single, married with or without dependents. This is a factor in what your taxable income is and what your take home pay will be.</p>
<p>Example: Employees who file as single and earn less than $9,325 annually are taxed at 10 percent income tax bracket rate for 2017. The average for those earning wages of more than $9,325 and up to $37,950 for 2017 would be at 15 percent and $37,950 and $91,900 wages are taxed at 25%. <h2>Average Tax Rates on Taxable Income</h2>
<p>In the U.S., you may likely fall into the average tax rate category. According to the IRS, employees pay an average tax rate of 31.5 percent on their wages.</p>

<h2>HRA Plan Overview</h2>
<p>Your employer creates an HRA account for each employee. There’s no cost to you, as your employer is responsible for funding. Pre-tax dollars fund the HRA at the beginning of each plan year. As long as funds are available, then you can use the funds to pay for eligible expenses. In some cases, your funds carry over from one plan year to another. However, it depends on the type of plan chosen by your employer.</p>
<p>An HRA isn’t the same as a health savings plan or a flexible spending plan. The plans are often confused, and therefore it’s important to know which one your employer provides.</p>
<h2><strong>Eligible and Ineligible Expenses</strong></h2>
<p>Eligible HRA expenses are those paid for out of pocket for medical care. Anything that diagnoses, cures, treats, or prevents diseases or illnesses is generally covered. Transportation for medical care is covered as well. You, your spouse, and eligible dependents can use the funds.</p>
<p>Any costs paid for with an HRA can’t also be reimbursed under any other health reimbursement plan. In other words, you can’t double-dip and get reimbursed twice for the same expense.</p>
<p>Ineligible expenses include things like elective cosmetic surgery, teeth whitening, herbs, family or marriage counseling, and imported prescription drugs.</p>
<h2><strong>Maximum Reimbursement</strong></h2>
<p>The maximum available from the HRA is equal to the available balance. It’s possible that the amount you need will exceed the balance. If that happens, then the remaining balance will process when the funds are available.</p>
<p>Some plans are limited by an account cap. Funds can’t exceed the cap, and your employer won’t add funds until the balance is below the cap. You also forfeit any funds in your plan if the funds don&#8217;t roll over into the next plan year.</p>
<h2><strong>Requesting Reimbursement</strong></h2>
<p>To request reimbursement, you must complete a Request for Reimbursement form. Proof of purchase or service is required. Valid forms of proof include statements or itemized receipts from your doctor, a pharmacy receipt, and a written prescription and receipt. For insurance premium reimbursement, you need a copy of the billing notice with proof of payment.</p>
<h2><strong>Speak with Your Employer</strong></h2>
<p>The high cost of medical care is a concern for many people. Being able to recoup some of your medical costs is a great financial help. The savings add up, as you don&#8217;t have to pay taxes on the money in your HRA or on the reimbursed expenses.
